Epistemic Recorder – End User License Agreement (EULA)

Effective date: [2025-12-20] Publisher (“MiulusTek”, “we”, “us”): MiulusTek Oy App: Epistemic Recorder (Android) and associated components

This End User License Agreement (“EULA”) governs your installation and use of the Epistemic Recorder application (the “App”). By installing or using the App, you agree to this EULA.

1. License Grant

MiulusTek grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App for lawful purposes in accordance with this EULA.

2. What the App Does

The App is a capture tool designed to produce tamper-evident media by:

• computing hashes over captured bytes (including chunk hashing and Merkle structures where applicable),
• signing a cryptographic manifest using device-backed keys when available, and
• embedding provenance data into captured media for later verification.

The App may expose a “trust tier” or similar device integrity status derived from device security and attestation signals.

3. Important Limitations (Verification ≠ Truth)

1. The App’s cryptographic capture features help detect later tampering of the file.
2. The App does not guarantee that captured content is factually true, complete, lawful, ethical, or admissible in court.
3. Trust tier results can change depending on device integrity, OS state, and third-party attestation services. A high trust tier is not guaranteed.

4. Permissions & Your Responsibility

You are responsible for complying with all laws and regulations relating to:

• recording and surveillance,
• consent requirements,
• privacy and data protection,
• restricted locations and sensitive subjects.

You must obtain all required permissions before recording.

5. Restrictions

You may not:

• attempt to bypass or defeat security features of the App,
• modify the App, or create derivative works (except where permitted by law),
• reverse engineer the App except to the extent prohibited by law,
• use the App to produce or distribute forged provenance claims.

6. User Content

You retain ownership of media you capture. The App may store captured media locally and/or allow you to export or upload media. Any upload or sharing is initiated by you or your configured workflow.

If you use MiulusTek hosted services, separate Terms & Conditions may apply.

7. Third-Party Services

Some App features may rely on third-party platform services (for example, device integrity and attestation providers). These services are outside MiulusTek’s control and may change, become unavailable, or behave differently over time.

8. No Warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIULUSTEK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MiulusTek does not warrant:

• uninterrupted or error-free operation,
• compatibility with every device,
• availability or permanence of third-party attestation systems,
• that any captured media will be accepted by third parties.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIULUSTEK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE.

MIULUSTEK’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

10. Termination

This EULA remains in effect until terminated. MiulusTek may terminate this EULA if you breach it. Upon termination, you must stop using the App and uninstall it.

11. Governing Law

This EULA is governed by the laws of Finland, excluding conflict-of-law principles.
